Website Return Policy vs EU Return Regulations

Over a week ago I bought a pair of pants online which did not fit me well. I was planning to return them today, so I checked the online store's return policy in case I needed to print and fill in the return form. The online store's policy states: Every return must be made within 3 days of receipt, returns requested after 3 days period will not be accepted. The item was sent to me from Italy to another EU country I'm based in. To be honest, up until today I thought that I can return any online purchase within 14 days because of EU policies. Am I eligible to return the product, despite the info on store's website? If yes, should I fill in some kind of form or add written statement and send it alongside the item I'm returning?

If you and the store are indeed in the EU then this isn't a legal return policy and you should be able to return under the Consumer Rights Directive 2011/83/EU. That might have been transposed into a local law so check that too. 14 day cooling of period from point of delivery is the key here. That said, if this is from the company that I just found it looks like they could be running a slightly shading dropshipping operation with an Italian front but you may have actually made payment to a Korean company. In which case good luck. However, website T&Cs say they are subject to Italian law.
