Key Points: - FMLA (Family and Medical Leave Act): Always unpaid and has no associated benefits. - Concerns with Multiple Jobs:   - Working while on FMLA is considered fraud.   - Taking unpaid leave from both jobs might avoid potential issues. - Unpaid Leave of Absence (LOA):   - Possible to take without formally applying for FMLA or other benefits.   - Some companies prohibit accepting new employment during LOA.   - No paper trail if not applying or filing for anything. - Factors Influencing Decisions:   - Situation-specific.   - State regulations play a role.   - Employer reports to the state. - Notes on FMLA:   - Unlimited FMLA applications with OE.   - Concerns with Short-Term Disability (STD) – potential fraud if more than one or if it's the same insurance company.   - Internal company payment for parental leave (without insurance) poses no issue.   - Some articles link FMLA with STD which can be problematic if the insurance company is involved.
TL;DR:
- Identify who's paying during OE FMLA:   - If it's the company: No worries.   - If it's insurance companies: Ensure they're different and proceed with caution.   - If it's the state: Be very careful. - Situations that are without government oversight and are 100% company paid have less potential issues.

For California, by someone here:
I applied for CA EDD disability benefits, and also both J1 and J2 short term disability claim, they all got approved. J1 and J2 short term disability pay me the difference between each of the STD benefit minus what CA EDD pay me Because my STD are insured by different companies.. it's not insurance fraud because we pay into the benefit separately to cover each J's salary loss CA EDD insurance cover 60% of salary UP TO 140k a year max Since my salary is > $140k, J1 and J2 insurance reimburse my 60% of my (XX salary - 140k) J1 STD insurance cover 60% of my XX salary - EDD payment J2 STD insurance cover 60% of my XX salary - EDD payment
